1. Finder Group Terms of Service

1.1 Introduction

These Terms of Service (the "Terms") govern your access to and use of the Apps Finder AI website and services (the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

These Terms constitute a binding legal agreement between you and Apps Finder AI (operated by Hive Empire Pty Ltd, ABN 18 118 785 121), and form part of the broader Finder Group Terms of Service.

1.2 Eligibility

You must be at least 18 years old to use our Services. By using our Services, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You are not prohibited from using the Services under any applicable laws
  • You will provide accurate, current and complete information

1.3 Account Registration

Some features of our Services may require you to register for an account. When you register for an account, you agree to:

  • Provide accurate and complete registration information
  • Maintain and promptly update your information to keep it accurate and current
  • Maintain the security and confidentiality of your account credentials
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or misleading.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use our Services for your personal, non-commercial use only.

The Apps Finder AI name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Apps Finder AI or its affiliates. You may not use such marks without our prior written permission.

Our Services may allow you to submit, upload, or otherwise make available content such as reviews, comments, or other materials ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media.

You represent and warrant that:

  • You own or have the necessary rights to submit the User Content
  • Your User Content does not infringe any third party's rights
  • Your User Content is accurate and not misleading
  • Your User Content does not violate these Terms or any applicable law

We welcome and encourage you to provide feedback, comments, and suggestions for improvements to the Services ("Feedback"). You acknowledge and agree that all Feedback will become our sole property, and we will be entitled to use and disclose Feedback for any purpose without compensation to you.

  • Your use or inability to use the Services
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Services
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Services by any third party
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content
  • The defamatory, offensive, or illegal conduct of any third party

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED ONE HUNDRED AUSTRALIAN DOLLARS (AUD $100).

1.9 Indemnification

You agree to indemnify, defend, and hold harmless Apps Finder AI, its affiliates, and their respective officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Services
  • Your User Content
  • Your violation of any rights of another party
  • Your violation of any applicable laws, rules, or regulations

1.10 Termination

1.10.1 Termination by You

You may stop using our Services at any time. If you have an account, you may terminate your account by contacting us at support@appsfinder.ai.

1.10.2 Termination by Us

We may suspend or terminate your access to the Services or your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Services will immediately cease.

1.10.3 Effect of Termination

All provisions of these Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

1.11 Governing Law and Dispute Resolution

1.11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in New South Wales, Australia.

1.11.2 Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or the Services, you agree to first contact us to attempt to resolve the dispute informally. If we are unable to resolve the dispute informally, any dispute shall be finally resolved by binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration.

1.12 General Provisions

1.12.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Services, constitute the entire agreement between you and Apps Finder AI concerning the Services.

1.12.2 Waiver and Severability

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

1.12.3 Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction.

Additional terms may apply to specific features or services offered through our platform. Such additional terms will be disclosed to you in connection with the applicable features or services. Additional terms are in addition to, and shall be deemed a part of, these Terms. In the event of a conflict, such additional terms shall prevail over these Terms.
